1、中国刑法中刑罚目的的合理化选择摘要刑罚目的是刑法理论中的一个极为重要的问题。刑罚的目的论在西方刑法理论中占有重要的地位。然而目前在这一问题上的认识却非常混乱。从西方刑法理论中的报应主义刑罚目的、预防主义刑罚目的和折衷主义刑罚目的到一元论、二元论和两层次论等数种在我国刑法学界占重要地位的刑罚目的。我们不难看出，西方刑法中的报应主义刑罚目的观蕴含着社会公正观念，合理的解释了刑罚正当化根据，由于报应论强调已然之罪对刑罚的决定作用，因而使刑罚的裁量具有了客观标准，能够最大限度地避免犯罪人遭受不公平的处罚。预防主义的刑罚目的
2、观则是强调刑罚的个别化，满足了预防犯罪的社会需要。折衷主义的刑罚目的观将报应论与预防论予以调和，强调刑罚目的对公正与效益地追求。本文从刑罚目的的一般含义和刑罚目的的界定来引出所要论述的刑罚目的。在回顾了刑罚目的理论的中西历史发展之后,评析了当前我国理论界的主要分歧,以“一元论”，“二元论”和“两层次论”的局限性为切入点展开论述,进而提出只有以惩罚犯罪，预防犯罪，保护法益为主要内容的三层次说刑罚目的，才是最适合我国国情的刑罚目的。关键词:犯罪;刑罚;刑罚目的;刑罚的任务;法益22AbstractPenaltyfort

6、idunfairpunishment.Thepurposeofthepenaltyandthepreventionofconceptionistheemphasisonindividualsentences,andtomeettheneedsofthecommunitycrimeprevention.Eclecticviewofthepenaltyforthepurposeofretributionandpreventionwillbetoreconcilethetheory,stressingthepurpose
