2、认定制度具有缺陷，通过司法途径骗取驰名商标的路径现实存在。商标侵权之诉适用的自认制度与法官在诉讼中消极中立的地位，使虚假诉讼的制造有机可乘。而诉讼欺诈的责任缺失却使虚假诉讼的违法成本几乎为零。2009年最高人民法院关于驰名商标的司法解释，在一定程度上缓解了驰名商标司法认定的异化现象，却没有对虚假诉讼起到根本性的抑制作用。驰名商标的司法认定制度仍需继续寻求制度措施与法律规定的完善。驰名商标司法认定制度距回归到立法者保护驰名商标所有人的合法权益、维护商标制度的本意，还有很大的距离。关键词：驰名商标司法认定异化回归   -..
