3、0'sorearly1970'stheProduceExchangedisbandedanditsfunctionsweretakenoverbywhatwasknownastheInternationalCommodityExchangewhich,itisunderstood,isnowdefunctorinactive. Withnoup-datingoramendmenttotheNYPEsince1946,afirstattempttomodernisethecharterwasinitiatedbyTheAssociationof
4、ShipBrokers&Agents(U.S.A.),Inc.(ASBA),NewYorkin1977.DuringtherevisionworkASBAundertookawideconsultationwithinterestedpartiesincludingTheBalticandInternationalMaritimeCouncil(BIMCO)andTheGeneralCouncilofBritishShipping(nowTheChamberofShipping). Inpursuanceofthisinitiative,it
5、wasthewishofASBAnottoproduceanentirelynewformbuttoamendthe1946Formbyincorporatingthechangeswhichwerethenmostfrequentlybeingmadeinthenegotiatingoftimechartersinthemarketplace.Nexttothis,ASBAdecidedthatclausesonlyoccasionallynegotiatedshouldnotbeincludedintherevisedform,butwo
6、uldbeplacedinanattachedRiderofSuggestedAdditionalClausessomeorallofwhichmightthenbeaddedtothebasiccharterwhensoagreedbythepartiesinvolvedinaparticularfixture. Therevisedform,knownasthe"ASBATIME"waspublishedbyASBAin1981butgainedonlylimitedacknowledgmentanduseinthemarketplace
