2、THEEUROPEANCOMMUNITIES,(4)DMFwasmostoftencontainedinlittlepouchesfixedinsidethefurnitureoraddedtothefootwearboxes.Itthusevaporatedandimpregnatedtheproduct,protectingitfrommoulds.However,itthenalsoaffectedconsumerswhowereincontactwiththeproducts.DMFpenetratedHavingregardtotheTreatyestablishingthe
3、Europeanthroughtheclothesontoconsumers’skin(2)whereitCommunity,causedpainfulskincontactdermatitis,includingitching,irritation,redness,andburns;insomecases,acuterespiratorytroubleswerereported.Thedermatitiswasparticularlydifficulttotreat.ThepresenceofDMFisthusaseriousrisk.HavingregardtoDirective2
4、001/95/ECoftheEuropeanParliamentandoftheCouncilof3December2001ongeneralproductsafety(1),andinparticularArticle13thereof,HavingconsultedtheMemberStates,(5)UnderArticle13ofDirective2001/95/EC,iftheEuropeanCommissionbecomesawarethatcertainproductspresentaseriousrisktothehealthandsafetyofconsumers,i
5、tmay,subjecttocertainconditions,adoptadecisionrequiringMemberStatestotakemeasuresWhereas:intendedinparticulartorestrictormakesubjecttospecificconditionstheavailabilityonthemarketofsuchproducts.(1)PursuanttoDirective2001/95/ECproducersareobligedtoplaceonlysafeconsumerproductsonthemarket.(6)Suchad
6、ecisionmaybeadoptedif(a)MemberStates(2)FurnitureandfootwearavailableonthemarketinseveraldiffersignificantlyontheapproachadoptedortobeMemberStateshavebeenidentifiedasthecauseofadoptedtodealwiththeriskconcerned;(b)theriskdamagetothehealthofconsumersinFrance,Poland,cannot,inviewofthenatureofthesafe
7、tyissue,beFinland,SwedenandtheUK.dealtwithinamannercompatiblewiththedegreeofurgencyofthecaseunderotherprocedureslaiddownbythespecificCommunitylegislationapplicabletotheproductconcerned;and(c)theriskcanbeeliminatedeffectively
