1、中文摘要虚拟财产作为一种新鲜事物，区别于传统财产而具有新的特征。由于目前司法实践中侵犯虚拟财产的案件层出不穷，而且我国立法对于虚拟财产的保护处于空白地带，为了我国网络产业的健康发展和公民所拥有的虚拟财产能够得到保护，将虚拟财产纳入到刑法的保护已经势在必行。只有这样才能为处理侵犯虚拟财产的案件提供立法依据。本文分为四章对虚拟财产的刑法保护进行论述：第一章，主要对虚拟财产的概念、特征、内涵及外延进行了考察和讨论，为虚拟财产下了定义；并且对虚拟财产的财产属性和法律属性进行了论述，分析学界的观点后，得出虚拟财产具有财产属性，应受到刑法的保护；第二章，主要是

2、对虚拟财产的国内外研究现状进行了论述，域外的立法现状可以得到借鉴：第三章，主要是对虚拟财产刑法保护的理论依据进行了论述，肯定了虚拟财产刑法保护的可能性和必要性；第四章，主要是对虚拟财产刑法保护的一些构想的论述，分为立法和司法两方面的构想，希望能为司法工作提供一些帮助。关键词：虚拟财产：刑法保护；财产属性AbstractVirtualproperty鹪anewthingdifferent610mthetraditionalpropertywithnewfeatures．Duetothecurrentjudicialpracticeincasesofv
