2、efromcivilliabilityarisingoutofhisorheruseofforcethatisintendedorlikelytocausedeathorgreatbodilyharmiftheactorreasonablybelievedthattheforcewasnecessarytopreventimminentdeathorgreatbodilyharmtohimselforherselfortoanotherpersonandeitherofthefollowingapplies:(a)Thepersonagainstwhomt

3、heforcewasusedwasintheprocessofunlawfullyandforciblyenteringtheactor’sresidence,theactorwaspresentintheresidence,andtheactorkneworhadreasontobelievethatanunlawfulandforcibleentrywasoccurring.a.Thepersonagainstwhomthedefensiveforcewasusedwasintheprocessofunlawfullyandforcefullyente

4、ring,orhadunlawfullyorforcefullyentered,adwelling,residence,oroccupiedvehicle,orifthatpersonhadremovedorwasattemptingtoremoveanotheragainstthatperson’swillfromthedwelling,residence,oroccupiedvehicle;and(b)Thepersonagainstwhomtheforcewasusedwasintheactor’sresidenceafterunlawfullyan

5、dforciblyenteringit,theactorwaspresentintheresidence,andtheactorkneworhadreasontobelievethatthepersonhadunlawfullyandforciblyenteredtheresidence.b.Thepersonwhousesdefensiveforcekneworhadreasontobelievethatanunlawfulandforcibleentryorunlawfulandforcibleactwasoccurringorhadoccurred.

6、(3)Anactorispresumedtohavereasonablybelievedthattheforcewasnecessarytopreventimminentdeathorgreatbodilyharmtohimselforherselfortoanotherpersonifeithersub.(2)(a)or(b)applies.(1)Apersonispresumedtohaveheldareasonablefearofimminentperilofdeathorgreatbodilyharmtohimselforherselforanot
