3、ingWinters,establishedthatcourtscanfindfederalrightstoreservewaterforparticularpurposesif(1)thelandinquestionlieswithinanenclaveunderexclusivefederaljurisdiction,(2)thelandhasbeenformallywithdrawnfromfederalpubliclands—i.e.,withdrawnfromthestockoffederallandsavailableforprivateuse
4、underfederallanduselaws—andsetasideorreserved,and(3)thecircumstancesrevealthegovernmentintendedtoreservewateraswellaslandwhenestablishingthereservation.SomeAmericanIndiantribeshavealsoestablishedwaterrightsthroughthecourtsbasedontheirtraditionaldiversionanduseofcertainwaterspriort
5、otheUnitedStates’acquisitionofsovereignty.Forexample,theRioGrandepueblosalreadyexistedwhentheUnitedStatesacquiredsovereigntyoverNewMexicoin1848.AlthoughtheyatthattimebecamepartoftheUnitedStates,thepueblolandsneverformallyconstitutedapartoffederalpubliclands;inanyevent,notreaty,sta
6、tute,orexecutiveorderhaseverdesignatedorwithdrawnthepueblosfrompubliclandsasAmericanIndianreservations.Thisfact,however,hasnotbarredapplicationoftheWintersdoctrine.WhatconstitutesanAmericanIndianreservationisaquestionofpractice,notoflegaldefinition,andthepuebloshavealwaysbeentreat
7、edasreservationsbytheUnitedStates.ThispragmaticapproachisbuttressedbyArizonav.California(1963),whereintheSupremeCourtindicatedthatthemannerinwhichanytypeoffederalreservationiscreateddoesnotaffecttheapplicationtoitoftheWintersdoctrine.Therefore,thereservedwaterrightsofPuebloIndians
