3、tedandshallenterintoforceasofOctober1,2004.August22,2004ChapterIgeneralprovisionsArticle1forthepurposeofregulatingthefranchisingactivitiesofmunicipalpublicutilities,andsafeguardthepublicinterestandthelawfulrightsandinterestsofthefranchisee,promotethedevelopmentofpubli
4、cutilities,accordingtotherelevantstatelawsandregulations,andthesemeasures.Referredtoinarticle2hereofmunicipalpublicutilityfranchise(hereinafterreferredtoasthefranchise),referstothecitizens,legalpersonsorotherorganizationsauthorizedbytheadministrativespecialpermissiona
5、nd,incertainperiodandrangeofpublicutilitiesmanagement.Thescopeoffranchisingis:(1)urbanwatersupply,gassupplyandcentralheating;(2)urbansewagetreatmentandhouseholdwastedisposal;(3)urbanpublicpassengertransport;(4)maintenanceofmunicipalpublicfacilitiessuchasroads,Bridges,
6、lightsandlandscaping;(5)cleaningandcleaningofliferefuse.Article3toencouragetheuseofsocialfundsandoverseascapital,andtobuildmunicipalpublicfacilitiesintheformofsoleproprietorship,jointventureandcooperation,andengageinfranchising.Article4theimplementationoffranchisingof
7、municipalpublicutilitiesshallbegovernedbytheprinciplesofopenness,fairness,impartialityandpublicinterests.Article5theownershipofmunicipalpublicfacilitiesinvestedandconstructedbythegovernmentshallbelongtothegovernment.Thefranchisorshall,aftertheexpirationorterminationof
8、thefranchise,returntothegovernmentforfree,inaccordancewiththemunicipalpublicfacilitiesplannedandinvestedbythecity.Article6th
