1、ANNEX2UNDERSTANDINGONRULESANDPROCEDURESGOVERNINGTHESETTLEMENTOFDISPUTESMembersherebyagreeasfollows:Article1CoverageandApplication1.TherulesandproceduresofthisUnderstandingshallapplytodisputesbroughtpursuanttotheconsultationanddisputesettlementprovisio

2、nsoftheagreementslistedinAppendix1tothisUnderstanding(referredtointhisUnderstandingasthe"coveredagreements").TherulesandproceduresofthisUnderstandingshallalsoapplytoconsultationsandthesettlementofdisputesbetweenMembersconcerningtheirrightsandobligatio

3、nsundertheprovisionsoftheAgreementEstablishingtheWorldTradeOrganization(referredtointhisUnderstandingasthe"WTOAgreement")andofthisUnderstandingtakeninisolationorincombinationwithanyothercoveredagreement.2.TherulesandproceduresofthisUnderstandingshalla

4、pplysubjecttosuchspecialoradditionalrulesandproceduresondisputesettlementcontainedinthecoveredagreementsasareidentifiedinAppendix2tothisUnderstanding.TotheextentthatthereisadifferencebetweentherulesandproceduresofthisUnderstandingandthespecialoradditi

5、onalrulesandproceduressetforthinAppendix2,thespecialoradditionalrulesandproceduresinAppendix2shallprevail.Indisputesinvolvingrulesandproceduresundermorethanonecoveredagreement,ifthereisaconflictbetweenspecialoradditionalrulesandproceduresofsuchagreeme

6、ntsunderreview,andwherethepartiestothedisputecannotagreeonrulesandprocedureswithin20daysoftheestablishmentofthepanel,theChairmanoftheDisputeSettlementBodyprovidedforinparagraph1ofArticle2(referredtointhisUnderstandingasthe"DSB"),inconsultationwiththep

7、artiestothedispute,shalldeterminetherulesandprocedurestobefollowedwithin10daysafterarequestbyeitherMember.TheChairmanshallbeguidedbytheprinciplethatspecialoradditionalrulesandproceduresshouldbeusedwherepossible,andtherulesandproceduressetoutinthisUnde

8、rstandingshouldbeusedtotheextentnecessarytoavoidconflict.Article2Administration1.TheDisputeSettlementBodyisherebyestablishedtoadministertheserulesandproceduresand,exceptasotherwiseprovidedinacoveredagreement,theconsultationanddisputesettlement
