2、conomicCommunity,andinparticularArticle100Athereof,HavingregardtotheproposalfromtheCommission(1),IncooperationwiththeEuropeanParliament(2),HavingregardtotheopinionoftheEconomicandSocialCommittee(3),Whereasthelaws,regulationsandadministrativeprovisionsinforceinthevariousMemberSt
3、atesrelatingtothesafetycharacteristicsoftoysdifferinscopeandcontent;whereassuchdisparitiesareliabletocreatebarrierstotradeandunequalconditionsofcompetitionwithintheinternalmarketwithoutnecessarilyaffordingconsumersinthecommonmarket,especiallychildren,effectiveprotectionagainstt
4、hehazardsarisingfromtheproductsinquestion;Whereastheseobstaclestotheattainmentofaninternalmarketinwhichonlysufficientlysafeproductswouldbesoldshouldberemoved;whereas,forthispurpose,themarketingandfreemovementoftoysshouldbemadesubjecttouniformrulesbasedontheobjectivesregardingpr
5、otectionofconsumerhealthandsafetyassetoutintheCouncilresolutionof23June1986concerningthefutureorientationofthepolicyoftheEuropeanEconomicCommunityfortheprotectionandpromotionofconsumerinterests(4);Whereas,tofacilitateproofofconformitywiththeessentialrequirements,itisnecessaryto
6、haveharmonizedstandardsatEuropeanlevelwhichconcern,inparticular,thedesignandcompositionoftoyssothatproductscomplyingwiththemmaybeassumedtoconformtotheessentialrequirements;whereasthesestandardsharmonizedatEuropeanlevelaredrawnupbyprivatebodiesandmustremainnon-mandatorytexts;whe
7、reasforthatpurposetheEuropeanCommitteeforStandardization(CEN)andtheEuropeanCommitteeforElectrotechnicalStandardization(CENELEC)arerecognizedasthecompetentbodiesfortheadoptionofharmonizedstandardsinaccordancewiththegeneralguidelinesforcooperationbetweentheCommissionandthosetwobo
