trademarkinfringementcriteriaofChinaisexactlythesamewitharticle9,thefirstparagraph
intheEuropeanCommunityTrademarkRegulation(CMTRforshort).Studyingthe
trademarkinfringementcriteriaconstituteinEur
3、opeanUnion(EUforshort)hasthe
significanceofreferencetotheruleof57(1)and57(2)inthetrademarklawofthePeople’s
RepublicofChinaIntheEU,itwillbeidentifiedasinfringingwithoutconsideringthelikelihoodof
confusionwhenthegoodsandtrademarkareallthesame.Butwhenoneoftwoisthesame
andtheotherissimilarity,i
4、tmustplusthelikelihoodofconfusion.Thatistosay,The
trademarkinfringementcriteriainEUis“similarityandthelikelihoodofconfusion”inthis
condition.Therelationshipbetweensimilarityandconfusionisthat,theformeractsasa
benchmark,andthelatteristhelimiter.Whendecidedthesimilarity,boththeCMTRandthe

5、peancourtonlydefineditobjectivelywithoutconsiderationofconfusion.Article7,the
thirdparagraphinthereasonsoftheCMTRiscustomarilytranslatedtobethatthedefinition
ofsimilarityisbuiltonconfusionwhiletheexactmeaningoforiginalonlyshowsthe
relevancetoconfusion.Priortothewrongunderstanding,similarity

demonstrateerroneously.Thebasicsofthedefinitionofsimilarityareoverallevaluationprinciples.Whendecided
trademarksinfringement,similarityisthefactorcomplementarytofactorslikeauditory,visual,
andotherparts,whiletheapparentpartsofthatplayanimportantrole.Similarityof

7、rkincludesfactorsofthenatureofthegoodsorservices,customsandusage,andit
shouldmakesureallthesefactorsabovecomplementeachother.Moreover,alltherelevant
