1、分类号学校代码10542密级学号2Q!QQ2Q!QQ!!我国法院的宪法地位及实现Thecourt，sconstitutionalstatus1●1JJ●●oannlmDlementatloninourCOUntrV湖南师范大学学位评定委员会办公室二0一三年五月摘要在司法改革过程中，仅在技术层面上进行单一的制度设计，而不涉及到政治体制改革与宪法文本内部之项层设计，是难以实现法院宪法之地位的。法院宪法地位之实现既依赖于符合现代宪政国家之要求的宪法文本之规定，更离不开宪法文本之规定在社会生活中的落实，构建相应的制度保障法院及法官独立行使司法权，使法院建立起有效的权威，真正担负起宪法和

2、法律的守护者角色，成为保障公民权益的坚实屏障。这是现代宪政国家对一国法院最基本的定位。然通过对我国历部宪法对法院地位之规定以及对法院实践样态之考察，法院宪法地位在现实中表现为：一是司法权威低下；二是法院行政体制化；三是法院地方化。究其主因有以下三个方面：(一)宪法法律关于法院宪法地位规定之不足；(二)法律没有实现其应有权威；(三)错误司法理念下法院对宪法的偏离。为回应现实之问题，通过对问题之阐释以及原因之释明，拟通过对法院内外部关系之理顺，完善宪法法律对审判独立之规定并对法官遴选制度和法官惩戒制度之改革，使我国法院的宪法地位达到一个现代宪政国家应有之要求。关键词：宪法；法院；宪
