3、an,andhasinfactbeenusedto,refertotwodiametricallyoppositeconceptsoftranslation.Ontheonehand,“translationasculturaltransfer”canbeunderstoodas“translationasanactofcross-culturalcommunicationeffectedbymatchingthecultural,ratherthanthelinguistic,elementsofthetwolanguagesinvolved.”On
4、theotherhand,“translationasculturaltransfer”canalsobeunderstoodas“translationasaprocessofimporting,oreventransplanting,thecultureofthesourcelanguageintothecultureofthetargetlanguage.”Understoodintheformersense,translationisessentiallyanactofdomestication,requiringno,orlittle,lin
5、guisticorconceptualadjustmentofthetargetlanguage,whereasunderstoodinthelattersense,translationinvolvesbothlinguisticandconceptualadjustmenttoaccommodatetheimportedculture,thusalwaysresultingintheforeignizationofthetargetlanguage.Thisstudyexaminesthesetwosensesofculturaltransferi
6、nthecontextoflawtranslation.UsingthetranslationofthecommonlawintoChineseinHongKongasacasestudy,itinvestigateswhichofthetwosensesisrelevanttolawtranslation,whichaspectoraspectsofthecultureofthecommonlawhasorhavebeentransferred,howsuchtransferhasbeeneffected,andwhatformithastaken.
7、Throughacriticalanalysisiiioftheproblemsinvolvedinthetranslatingprocessinquestion,itishopedthatthisstudywillshedsomelightonthequestionofculturaltransfer,andmoreimportantly,onthenatureoflegaltranslation.Thisthesisisdividedintotwomajorparts.PartIconsistsoffourchaptersthatprovideth
