2、ssionoftheEuropeanCommunities(hereinafterreferredtoasthe"Commission"),andtheRepublicofLatvia(hereinafterreferredtoas"Latvia"orthe"Borrower"),representedbytheMinisterofFinance,MrAtisSlakteris,andtheBankofLatviaactingasAgentonbehalfoftheBorrower(hereinafterreferredtoasthe"Borrower'sA
3、gent"),representedbytheGovernoroftheBankofLatvia,MrIlmārsRimšēvičs.PreambleWhereas:(1)CouncilRegulation(EC)No332/2002of18February2002establishingafacilityprovidingmedium-termfinancialassistanceforMemberStates'balancesofpayments(OJL53,23.2.2002,p.1)empoweredtheCommissiononbehalfofth
4、eECtocontractborrowingsonthecapitalmarketsorwithfinancialinstitutionswiththeaimtograntloanstooneormoreMemberStateswhichareexperiencing,orthreatenedwith,difficultiesintheirbalanceofcurrentpaymentsorcapitalmovements;(2)Latviahasrequestedmedium-termfinancialassistance;(3)TheCouncil,by
5、itsDecision5255/09of20January2009(hereinafterreferredtoasthe"Decision")decidedtograntLatviaunderRegulation(EC)No332/2002aloanamountingtoamaximumofEUR3100000000withamaximumaveragematurityofsevenyears.Theloanshallbemadeavailableinmaximumsixinstalments;(4)Theloanisgrantedinconjunction
6、withaloanfromtheInternationalMonetaryFundofSDR1.5billion(aroundEUR1.7billion)underaStand-byarrangementapprovedon23December2008.Inaddition,theNordiccountries(Sweden,Denmark,Finland,NorwayandEstonia)aretocontributeEUR1.9billiontogether,theWorldBankEUR0.4billion,theEuropeanBankforReco
7、nstructionandDevelopment,theCzechRepublicandPolandatotalofEUR0.4billion,bringingthetotalassistancetoEUR7.5billionovertheperiodtothefirstquarterof2011;(5)TheloanislinkedtoeconomicpolicymeasuresdesignedtosupportLatvia'sbalanceofpaymentssustainabilityasdeterminedinArticles2and3oftheDe
