1、摘要当使用者为合法使用一些作品想取得权利人授权时，往往会出现找不到权利人的情况，此时使用者只能放弃使用这些作品，此类作品就是本文所要论述的孤儿作品。不难看出，孤儿作品将会造成社会资源的冻结闲置阻碍人类的创作。这种现象已经引起了很多国家的关注，一些国家也为如何对这类作品进行使用提出了一些可行的解决方式。本文主要介绍一下几种方式，一是将孤儿作品的使用合法化的解决方式：分别为通过立法设定特例授权的特例授权方式、集体管理组织的扩展性授权方式、两者相结合的方式，以上三种方式认为对孤儿作品的使用是合法的；二是将孤儿作品的使用视为侵权的解决方式，即美国的侵

2、权限制制度，美国的((2008年孤儿作品法案》仍然将使用者未经许可使用孤儿作品视为侵权，但与其他侵犯版权的权利人的救济相比，立法限制了孤儿作品权利人的救济方式，包括禁制令和赔偿金额的限制。笔者认为，孤儿作品问题已经成为世界性的问题，中国在借鉴上述外国的解决方式的基础上，应该结合本国国情尽快建立孤儿作品的使用制度，笔者将在本文的第四部分提出一些具体建议。关键词：著作权，孤儿作品，侵权，谷歌数字图书馆案，限制救济ABSTRACTOrphanworksrefertoworkstherightsholderofwhichcannotbelocated
