2、s 1.Inordertoregulatetheproceduresoftherulesformulatingandmaintainqualityoftherules,theRegulationsonProceduresoftheRulesFormulating(Provisions)areherebyenactedinaccordancewithpertinentprovisionsoftheLegislationLaw. 2.TheseProvisionsareapplicabletot
3、heinitiation,drafting,examination,decision-making,promulgationandinterpretationoftherules.AnyruleformulatedinviolationoftheseProvisionsshallbeinvalid. 3.TherulesshallbeformulatedincompliancewiththelegislativeprinciplesasprescribedbytheLegislationLaw
4、andtherequirementsoftheConstitutionLaw,laws,administrativeregulationsandanyothersuperiorlaws. 4.Thelawfulrightsandinterestsofthecitizens,legalentitiesandotherorganizationsshallbeprotectedbyformulationoftheruleswhenthedutiestobefulfilledareprovidedwi
5、ththecorrespondingrightsandthesafeguardmeans. Theprincipleofbalancedpowerandresponsibilityintheadministrativeauthoritiesshallbefollowedinformationoftherules,wherebytheadministrativeauthoritiesaregrantedthenecessarypowersunderspecifiedconditionsandpr
6、oceduresrequirements. 5.Theformulationofrulesshalldemonstratethespiritofreform,regularizeadministrativeconductsinascientificmannerandpromotethegovernmentalfunctionstoshifttowardstheeconomicregulation,socialadministrationandpublicservice. Theformula
7、tionofrulesshallfollowtheprincipleofsimplicity,unityandefficiency,andthesameorsimilarfunctionsshallbeundertakenbyasingleadministrativeorgansothattheadministrativeprocedurescanbesimplified. 6.Therulesaregenerallynamedasthe“regulations”or“measures”,bu
8、tnotthe“Regulations”. 7.Therulesshallusethepreciseandconciselanguage,andcontainthedefinite,specificandoperablearticles. Onceincludedinthelawsandregulations,thecontentsshallnotberepeatedinprinciplebytherules. Therulesshallnotbedividedintochaptersan
