1、行政裁量论文：行政裁量的控制模式研究【中文摘要】近年来,随着监管职能的不断增加,安全生产行政执法中裁量的种类和范围也不断扩大。行政裁量权作为安全生产行政权的核心,既是安全生产监管的需要,有利于积极行政,同时也存在被滥用的可能和事实,造成极大危害。所以,对安全生产行政执法中裁量的控制显得尤为重要。本文对安全生产行政执法过程中裁量存在的问题、失控的原因以及控制模式的完善作了尝试性的研究。本文采用定性分析结合案例的研究方法,首先从现行国内外行政裁量的概念分析入手,简要阐述了当前行政裁量权的控制理论,涵盖了立法、行政、司法三个层次。其次,本文详细分析了行政裁量进入安全生产领域的现实基础、行政裁量
2、在安全生产行政执法实践中所表现出来的种类和特征以及存在的问题和出现问题的原因,旨在说明安全生产行政执法中裁量情形的复杂性和不可预测性。最后,本文力求从立法、行政、司法三个角度,通过事前、事中和事后三个环节建立和完善环环相扣的复合型行政裁量权控制模式来实现行政裁量权的控制目标。文章关于安全生产行政执法中行政裁量控制模式的研究,既丰富了学界关于行政裁量研究的成果,也有利于规范和控制安全生产行政执法过程中的裁量行为,为安全生产领域防止公权力异化方面的制度设计提供了一定的借鉴,具有很强的现实意义。【英文摘要】Withtheincessantincreaseofadministrativefunc
