废弃电器电子产品回收处理管理条例(Regulationsontheadministrationoftherecyclinganddisposalofwasteelectricalappliancesandelectronicproducts)OrderNo.551stoftheStateCouncilofthePeople'sRepublicofChinaTheregulationsontheadministrationoftherecyclingofwasteelectricalandelectronicproductshavebeenadoptedbythetwenty-thirdexecutivemeetingoftheStateCouncilonAugust20,2008andareherebypromulgatedandshallcomeintoforceasofJanuary1,2011.PrimeMinisterWenJiabaoTwoyearsnine,February25thRegulationsontheadministrationoftherecyclinganddisposalofwasteelectricalappliancesandelectronicproductsChapterIGeneralProvisionsArticle1inordertoregulatetheactivitiesofrecyclinganddisposalofwasteelectricalandelectronicproducts,promotethecomprehensiveutilizationofresourcesanddevelopmentofrecyclingeconomy,protecttheenvironment,safeguardinghumanhealth,accordingtotherelevantprovisionsofthe"People'sRepublicofChinaCleanerProductionPromotionLaw"and"solidwastepollutionpreventionlaw"ofthePeople'sRepublicofChinaenvironment,theenactmentofthisordinance. Secondaccordingtothestipulationsinprocessingwasteelectricalandelectronicproducts,referstothedismantlingofwasteelectricalandelectronicproducts,fromtheextractionofsubstancesasrawmaterialsorfuel,physicalandchemicalpropertiesofwasteelectricalandelectronicproductsbychangingthereductioninthenumberofwasteelectricalandelectronicproductshavebeenproduced,reduceoreliminatetheharmfulingredients,andthefinalwillbeinconformitywiththerequirementofenvironmentalprotectionactivitiesofthelandfill,notincludingtheproductmaintenanceandrenovationandmaintenanceandrenovationactivitiesbyusingthevintageas.TheseRegulationsshallapplytotherecycling,handlingandrelatedactivitiesofthewasteelectricalandelectronicproductslistedinthecatalogueofwasteelectricalandelectronicproducts(hereinafterreferredtoas"Catalogue"),third.TheDepartmentinchargeofcomprehensiveutilizationofresourcesundertheStateCouncilshall,inconjunctionwiththecompetentdepartmentsofenvironmentalprotection,industryandinformationindustryundertheStateCouncil,formulateandadjustthecatalogue,whichshallbeimplementedafterapprovalbythestatecouncil.FourthenvironmentalprotectiondepartmentoftheStateCouncilinconjunctionwiththecomprehensiveutilizationofresourcesundertheStateCouncilandthecompetentdepartmentofinformationindustryindustrialorganizationresponsiblefortheformulationoftherecoveryanddisposalofwaste electricalandelectronicproductsandcoordinatetheimplementationofpoliciesandmeasures,responsibleforthedisposalofwasteelectricalandelectronicproductssupervisionandmanagementwork.ThecompetentdepartmentofcommerceundertheStateCouncilshallberesponsiblefortheadministrationoftherecyclingofwasteelectricalandelectronicproducts.Thecompetentdepartmentsoffinance,industryandcommerce,qualitysupervision,taxationandcustomsoftheStateCouncilshallberesponsiblefortherelevantmanagementwithintheirrespectivefunctionsandresponsibilities.Fifthcountriestowasteelectricalandelectronicproductsmulti-channelrecyclingandcentralizedtreatmentsystem.Sixthcountriesonthewasteelectricalandelectronicproductsprocessingqualificationlicensingsystem.ThecompetentadministrativedepartmentforenvironmentalprotectionoftheMunicipalPeople'sgovernmentatthedistrictlevelshallexamineandapprovethequalificationsoftheenterprisesdealingwiththewasteelectricalandelectronicproducts(hereinafterreferredtoastheprocessingenterprises).Seventhcountriestoestablishwasteelectricalandelectronicproductsprocessingfundforwasteelectricalandelectronicproductsrecycling,processingcostssubsidies.Theproducersofelectricalandelectronicproductsandtheconsigneesortheiragentsofimportedelectricalandelectronicproductsshallfulfilltheobligationsofhandlingthewasteelectricalandelectronicproductsprocessingfundinaccordancewiththeregulations. Wasteelectricalandelectronicproductsprocessingfundsshallbeincludedinthebudgetmanagement,thespecificmeasuresofmanagement,collectionanduseofthefinancedepartmentundertheStateCouncilinconjunctionwiththeStateDepartmentofenvironmentalprotection,comprehensiveutilizationofresources,industrialadministrativedepartmentoftheinformationindustrydevelopment,afterbeingapprovedbythestatecouncil.Informulatingthecollectionstandardsandsubsidystandardsfordisposalfundsforwasteelectricalandelectronicproducts,theopinionsshallbegiventotheproducersofelectricalandelectronicproducts,theenterprisesconcerned,therelevanttradeassociationsandexperts.Theeighthstateencouragesandsupportsthescientificresearch,technologicaldevelopment,relevanttechnicalstandards,andthedemonstration,popularizationandapplicationofnewtechnologies,newtechnologiesandnewequipmentforthedisposalofwasteelectricalandelectronicproducts.Articleninthofthestatebannedtheimportofwasteelectricalappliances,electronicproductsshallnotbeimported.ThesecondchapteristheresponsibilityoftherelatedpartyTenthproducersofelectricalandelectronicproducts,importsofelectricalandelectronicproducts,theconsigneeoritsagentproduction,importsofelectricalandelectronic productsshallcomplywiththerelevantnationalelectricalandelectronicproductspollutioncontrolregulations,thedesignisconducivetothecomprehensiveutilizationofresourcesandharmlesstreatment,theuseofnon-toxicorlowtoxicityharmandtofacilitaterecyclingofmaterials.Intheelectricalandelectronicproducts,orintheproductspecifications,informationconcerningthecontentsoftoxicandharmfulsubstances,recyclingandpromptinstructionsshallbeprovidedinaccordancewiththeregulations.Eleventh,theStateencouragesproducersofelectricalandelectronicproductstoentrustorentrusttheirownsellers,maintenanceinstitutions,after-salesserviceinstitutions,recyclingoperatorsofwasteelectricalandelectronicproductstorecyclewasteelectricalandelectronicproducts.Electricalappliances,electronicproducts,sellers,maintenanceinstitutionsandafter-saleserviceinstitutionsshallmarkconspicuousinformationabouttherecyclingofwasteelectricalandelectronicproductsintheirplaceofbusiness.Therecyclingofwasteelectricalappliancesandelectronicproductsshallbehandledbytheprocessingenterpriseswiththequalificationforthedisposalofwasteelectricalandelectronicproducts.Twelfthoperatorsofwasteelectricalandelectronicproductsrecyclingshalladoptvariouswaystoprovideconvenientandquickrecyclingservicesforconsumersofelectricalandelectronicproducts. Wasteofwasteelectricalandelectronicproductselectronicproductsrecyclingoperatorselectricalappliancesontherecoveryprocess,shouldbeinaccordancewiththeprovisionsofthisOrdinancehasobtainedthequalificationfordisposalofwasteelectricalandelectronicproductsprocessing;withoutobtainingthequalification,shallpaytherecyclingofwasteelectricalandelectronicproductsprocessingenterpriseshavewasteelectricalandelectronicproductsprocessingqualificationprocessing.Afterthesaleoftherecoveredelectricalandelectronicproducts,itmustcomplywiththemandatoryrequirementsofthenationaltechnicalspecificationssuchassafeguardingthehealthofthehumanbodyandproperty,andmarkingitas"second-handgoods"atthemarkedposition.Thespecificadministrativemeasuresshallbeformulatedbythecompetentdepartmentofcommerceunderthestatecouncil.Thirteenthorgans,groups,enterprisesandinstitutionswillabandontheelectricalandelectronicproductstothedisposalofwasteelectricalappliances,electronicproductsprocessingenterprises,inaccordancewithrelevantstateregulationsfortheassetsverificationprocedures.Thedisposalofdiscardedelectricalandelectronicproductsinvolvingstatesecretsshallbehandledinaccordancewiththestatesecretsregulations.Fourteenthcountriesencourageenterprisestodealwithrelatedelectricalandelectronicproductsmanufacturers,sellersandscrapelectricalandelectronicproductsrecycling operators,suchaslong-termcooperativerelationship,recyclingwasteelectricalandelectronicproducts.Fifteenth,thedisposalofwasteelectricalandelectronicproductsshouldbeinlinewiththestate'scomprehensiveutilizationofresources,environmentalprotection,laborsafetyandtheprotectionofhumanhealthrequirements.Prohibittheuseofstateexplicitlyeliminatedtechnologyandtechnologytodisposeofwasteelectricalandelectronicproducts.Thesixteenthenterpriseshallestablishadailyenvironmentalmonitoringsystemforthedisposalofwasteelectricalandelectronicproducts.Seventeenthprocessingenterprisesshallestablishdatamanagementinformationsystemofwasteelectricalandelectronicproducts,submittedtotheMunicipalPeople'sgovernmentenvironmentalprotectiondepartmentswherethedistrictsofthewasteelectricalandelectronicproductsprocessingofthebasicdataandrelevantinformation.Thestorageperiodofthebasicdataforthedisposalofwasteelectricalandelectronicproductsshallnotbelessthan3years.Articleeighteenthenterpriseshandlingwasteelectricalandelectronicproductsshallenjoypreferentialtaxationinaccordancewiththerelevantregulationsofthestate.Nineteenthunitsandindividualsthatrecycle,store, transport,anddisposeofwasteelectricalandelectronicproductsshallabidebythestateregulationsontheadministrationofenvironmentalprotectionandenvironmentalsanitation.ThethirdchapterissupervisionandmanagementTwentiethcompetentdepartmentsundertheStateCouncil,suchascomprehensiveutilizationofresources,qualitysupervision,environmentalprotectionandindustrialinformationindustry,shallformulaterelevantpoliciesandtechnicalspecificationsforthedisposalofwasteelectricalandelectronicproductsinaccordancewiththeprescribedfunctions.Twenty-firstProvincialPeople'sgovernmentdepartmentinchargeofenvironmentalprotectioninconjunctionwiththecomprehensiveutilizationofresources,thecommerceandIndustryDepartmentinchargeoftheinformationindustryfortheregionofwasteelectricalandelectronicproductsdevelopmentplan,submittedtothecompetentdepartmentofenvironmentalprotectionundertheStateCouncilfortherecord.Thelocalpeople'sGovernmentshallincorporatewasteelectricalandelectronicproductrecyclingandinfrastructureconstructionintourbanandruralplanning.Twenty-secondqualifieddisposalofwasteelectricalandelectronicproducts,inaccordancewiththe"provisionsofPeople'sRepublicofChinacompanyregistrationregulations"andotherregistrationandinitsbusinessscopeasstatedin thewasteelectricalandelectronicproductsprocessingenterprises,beengagedinwasteelectricalandelectronicproductsprocessingactivities.Inadditiontotheprovisionsofarticlethirty-fourthoftheseregulations,theunitsandindividualswhohavenotobtainedthequalificationsforthedisposalofwasteelectricalandelectronicproductsareprohibitedfromhandlingwasteelectricalandelectronicproducts.Twenty-thirdapplicationsforthedisposalofwasteelectricalandelectronicproductsshallmeetthefollowingconditions:(1)completefacilitiesforthedisposalofwasteelectricalandelectronicproducts;(two)havetheproperutilizationordisposalplanofwasteelectricalappliancesandelectronicproductswhichcannotbecompletelytreated;(three)sorting,packagingandotherequipmentthatissuitableforthedisposalofwasteelectricalandelectronicproducts;(four)professionalandtechnicalpersonnelwithrelevantsafety,qualityandenvironmentalprotection.Twenty-fourthapplicationsforthedisposalofwasteelectricalandelectronicproductsshallbesubmittedtothecompetentdepartmentofenvironmentalprotectionoftheMunicipalPeople'sgovernmentatthesitewherethesiteislocated,andtherelevantsupportingmaterialsshallbe provided.Thecompetentdepartmentofenvironmentalprotectionthatacceptstheapplicationshallcompletetheexaminationwithin60daysfromthedateofreceiptofthecompleteapplicationmaterials,andmakeadecisionongrantingthelicenseornotgrantingpermission.Articletwenty-fifththecompetentdepartmentsofenvironmentalprotectionunderthepeople'sgovernmentsatorabovethecountylevelshallstrengthensupervisionandinspectionofthehandlingactivitiesofwasteelectricalandelectronicproductsthroughwrittenexaminationandon-the-spotexamination.Articletwenty-sixthanyunitorindividualhastherighttoinformtheauthoritiesconcernedinviolationoftheprovisionsoftheseregulations.Thedepartmentsconcernedshallkeepsecretsfortheinformantsandtimelyhandletheminaccordancewiththelaw.Thefourthchapter,legalresponsibilityTwenty-seventhinviolationofthepresentregulations,producersofelectricalandelectronicproducts,importsofelectricalandelectronicproducts,theconsigneeoritsagentproduction,importsofelectricalandelectronicproductsorproductinstructionsnotinaccordancewiththeprovisionsofrelevantcontent,recyclinganddisposaloftoxicandharmfulsubstancesindescriptionandotherinformation,bythelocalgovernmentatorabovethecountylevelpeople'sproductqualitysupervisiondepartmentshallorderwithinatimelimit,at50thousandyuanfine. Twenty-eighthinviolationoftheregulations,notmadeofwasteelectricalandelectronicproductsqualificationtoengageinwasteelectricalandelectronicproductsprocessingactivities,theadministrativedepartmentforIndustryandCommerceshallbepunishedinaccordancewiththeprovisionsofthe"measures"oftheunlicensedandbanned.Wherethecompetentenvironmentalprotectionadministrationfindsout,thecompetentdepartmentofenvironmentalprotectionunderthepeople'sgovernmentatorabovethecountylevelshallorderittoclosedownorclosedown,confiscatetheillegalgains,andimposeafineofnotlessthan50thousandyuanbutnotmorethan500thousandyuan.Twenty-ninthinviolationoftheregulations,theobsoletetechnologyandprocessingwasteelectricalandelectronicproducts,bytheenvironmentalprotectiondepartmentshallorderthepeople'sgovernmentsatorabovethecountylevelwithinatimelimit;ifthecircumstancesareserious,theMunicipalPeople'sgovernmentenvironmentalprotectiondepartmentsofdistrictsshallbesuspendeduntiltherevocationofthedisposalofwasteelectricalandelectronicproductsqualification.Articlethirtiethwherethewasteelectricalappliancesandelectronicproductsaretreatedforenvironmentalpollution,thecompetentdepartmentofenvironmentalprotectionunderthepeople'sgovernmentatorabovethecountylevelshallbepunishedinaccordancewiththerelevantprovisionsonthepreventionandcontrolofenvironmentalpollutionbysolid waste.Thirty-firstinviolationoftheregulations,nottheestablishmentofdatainformationmanagementsystemofwasteelectricalandelectronicproductsprocessingenterprises,failingtosubmitthebasicdataandrelevantinformationorsubmitbasicdata,thesituationisnottrue,ornotthedeadlinetopreservethebasicdataoftheMunicipalPeople'sGovernmentshallbeorderedbythecompetentdepartmentofenvironmentalprotectionofthedistricts.Makecorrections,canbefinedupto50thousandyuan.Thirty-second,inviolationoftheprovisionsoftheseregulations,theenterprisehasnotestablishedaroutineenvironmentalmonitoringsystemordidnotcarryoutroutineenvironmentalmonitoring,theenvironmentalprotectiondepartmentofthepeople'sgovernmentatorabovethecountylevelshallbeorderedtomakecorrectionswithinatimelimit,Youcanpayafineoflessthan50thousandyuan.Thirty-thirdinviolationoftheregulations,staffofrelevantadministrativedepartmentsofthebreachofprivilege,derelictionofduty,whichconstitutesacrime,shallbeinvestigatedforcriminalresponsibility;doesnotconstituteacrime,shallbepunishedaccordingtolaw.ThefifthchapteristhesupplementaryprovisionsThirty-fourth,throughtheapprovaloftheprovincialpeople'sgovernment,maysetupwasteelectricalandelectronicproducts centralizedprocessingfield.Thecentralizeddisposalofwasteelectricalandelectronicproductsshallhaveperfectconcentratedpollutiontreatmentfacilities,toensurecompliancewiththenationalorlocalstandardsofpollutantemissionsandsolidwastepollutionpreventiontechnicalstandards,andshallcomplywiththerelevantprovisionsoftheseregulations.Thecentralizedprocessingyardforwasteelectricalandelectronicproductsshallconformtotheplanforsettingupthestateandlocalindustrialparks,coordinatewithlocallanduseplanningandurbanandruralplanning,andaccelerateindustrialupgrading.Thesethirty-fifthregulationsshallcomeintoforceonJanuary1,2011.
