1、InterpretationoftheThirdInterpretationofMarriageLawAftertheamendmentofMarriageLawcameintoforcein2001,theSupremeCourthadannouncedtwointerpretationsonMarriageLawinDecember24,2001andDecember25,2003.AsthestatisticsoftheSupremeCourtdepicted,from2003to2011,m
2、arriageandfamilydisputesaroundhouse,paternitytestandotherareasthatlackofspecificregulationswereincreasedyearbyyear.Therefore,tocopewiththeabovedisputes,theSupremeCourtannouncedthethirdinterpretationofMarriageLawinAugust12,2011,andtheinterpretationcamei
3、ntoforceinAugust13,2011.ItattractedgreatattentionandleadtogreatcontroversysincetheannouncementofthedraftofthethirdinterpretationofMarriageLawonNovember15,2010.Theinterpretationarousedgreatsensation,especiallyforownershipofpropertybeforemarriageandafter
4、marriagethatregardedasthesensitivesubjectandarousedwideconcernandcontroversy.ThefollowingwereinterpretationofthethirdinterpretationofMarriageLaw.1，Administrativereviewandadministrativelitigationwereavailablewhendefectoccurredinmarriageregistration.Acco
5、rdingtoArticle1ofthethirdinterpretationofMarriageLaw,applicationfornullityofmarriagewouldberejectedexceptconditionsdepictedinArticle10MarriageLaw.Applicationfornullityofmarriageondefectofmarriageregistrationwouldberejectedeither,whereas,administrativer
6、eviewandadministrativelitigationwouldbeappliedinsuchsituations.Asaresult,onlywhendefectoccursinbothsubstanceandprocedureaspectscouldthejudgeaccepttheapplicationofnullityofmarriage.2，Partythatrefusespaternitytestshallbearunfavorableconsequences.Article2
7、ofthethirdinterpretationofMarriageLawindicatesthatpartywhorefusepaternitytestandunabletoprovideevidencewouldbearunfavorableconsequences.Itmeansthejudgewouldsupportclaimoftheotherpartybasedonevidenceofferedbyit.3，Claimfordivisionofcommonpropertymaybesup
