1、摘要由于《反垄断法》对反垄断执法机构与行业监管机构具体协调工作的规定模糊不清，导致了两机构的协调发展在反垄断法的实施过程中面临困境。因此，有必要对上述两类机构之间的竞争规制权限进行划分。本文第一章引言部分介绍了文章的分析背景、现状、目的以及文章结构。第二章通过分析当前我国反垄断执法机构与行业监管机构权力配置的格局及面临的理论和实践困境，阐明我国两机构权力配置的现状，认为重新合理配置我国两机构的权力迫在眉睫。第三章是本文的重点论述部分。笔者从两机构权力配置的共时性和历时性维度进行考察，旨在探索出适合我国市场竞争机制发展的

2、权力配置模式。通过对国际上三种权力管辖模式所依赖的社会经济环境以及优缺点的比较，现阶段为适应我国市场竞争机制尚不成熟的现状，我国宜采纳反垄断执法机构与行业监管机构合作管辖模式。第四章和第五章是本文的创新部分。通过参照国际相关经验并结合我国实际情况，设计了我国反垄断执法机构与行业监管机构的合作标准、合作思路以及合作机制；同时在合作的基础上，对两机构的权力制约作出了详细的分析。关键词：反垄断监管，反垄断合作管辖，反垄断权力制约Abstract“AntitrustLaw”didn’tcreatebordersbetweenC
