3、fhumanactivities,suchasliterature,socialregulation,religious,value,andsoon.Basedonthetheoriesofcontextofculture,thethesisconductsanelaboratestudyonlegaltermtranslation.Atthebeginning,thethesissystematicallydescribesthepreviousstudiesonlegaltranslationandlegaltermtrans
4、lationathomeandabroad.Andthenthethesisgoestointroducethetheoreticalfoundation,exploringthenotion,function,andcharacteristicofcontextandculturalcontext.Byusingalotofparticularexamples,thethesisexplainshowthemeaningoflegaltermsshiftsbytheinfluenceofculturalcontext,furth
5、erproposingthetranslationrequirementsforlegaltermbasedoncontextofculture,whichincludescomplyingwiththecharacteristicsoflegallanguage,adaptingtothehabitoflegallexicalexpression,meetingtheculturalbackgroundoftargetlanguage,seekingtomeaningequivalence,andcreatinganewlega
6、lterm.Throughthestudy,thethesiscomestotheconclusionthatthetranslatedlegaltextbecomesmoreaccuratewhencontextofcultureisappliedinlegaltermtranslation.Keywords:contextofculture,legalterm,translationstrategiesii摘要法律术语翻译是法律翻译的关键。法律术语反映的是一种法律制度和一个民族的文化特征，这使得法律术语的词义很难被准确定义。而
7、我们只有在充分考虑文化语境的前提下，才能达到准确的翻译。因此，文化语境在法律术语翻译中的应用研究具有重要的理论和实践意义。目前在语言学领域对文化语境的概念还没有统一的定义。但学者们普遍认为，文化语境代表的是人类活动的抽象概念，包括文学、社会规约、宗教信仰、价值观等等。本文依据文化语境理论，对法律术语的翻译进行了研究。首先，本文系统阐述了国内外学者对法律翻译和法律术语翻译的主要研究成果。其次，通过探究语境和文化语境的定义、功能和特征，为本文的研究建立理论基础。最后，本文引用大量典型例子来论证法律术语的词义在文化语境的影响下如何发生转
8、变，进一步基于文化语境有针对性地对法律术语的翻译提出了几点建议，包括符合法律语言特征、顺应法律词汇表达习惯、充分考虑译入语的文化背景、寻求词义对等、造新词。通过本文研究发现，把文化语境理论应用在法律术语翻译中，法律文本的译文会变得更准确。关键词：文
