1、摘要随着近些年来我国犯罪行为不断呈现复杂化、多元化，加上犯罪案件数量的不断增加，对我国刑事诉讼方面法律和制度的要求也越来越高。本文从论述起诉法定主义、起诉便宜主义的演变、发展着手，通过比较研究两大法系不同国家之间不起诉裁量权的异同以及最新的发展趋势，以及其他国家施行的与我国的酌定不起诉制度相类似的制度和规定，重点是分析日本的起诉犹豫制度、英国的公共利益检验原则以及美国的辩诉交易制度，以此来对比分析我国的酌定不起诉制度存在的利与弊，以及应如何借鉴国外先进制度的经验。本文主要采用纵向谈发展趋势，横向作对比比较的方法进行横纵双向分析研究，意在

2、扩大我国酌定不起诉制度的适用，并完善其发展。但是一项制度的确立和更改，是必须与之具体国情相适应的。我们并不能简单移植其他国家的成功经验，每一项制度的存在都是把双刃剑，我们必须从我国的具体国情、法情出发，去其糟粕取其精华，既要在现有制度的基础上继续优化酌定不起诉制度的立法，又要尝试新的制度，本文主要是从尝试建立中国特色的暂缓起诉制度以及辩诉交易制度这两个方面具体展开来研究的。同时，在完善制度本身的同时，我们也要适时相应地完善制约制度等既能保证制度顺利实施，又能防止制度权力被滥用的配套制度，以期待最有效的实施效果。关键词：酌定不起诉；起诉便
