2、控制手段，提出法律风险是网络银行发展过程中最重要的也是最亟待解决的问题。第三章是本论文的重点。本章以网络银行所涉及的法律关系为基点，分两大部分分析网络银行面临的基本的现实法律问题。从公法的角度讲，包括立法机关有关网络银行的立法活动、金融监管当局对网络银行的监督管理、电子货币的有关问题、网络犯罪对网络银行发展的影响四个方面。从私法的角度讲，包括网络银行与网络服务商之间的法律关系、网络银行与客户之间的法律关系两个方面，其中着重解决的是网络银行与客户之间的法律关系问题。第四章本文结束语中指出了我国在网络银行立法方面空自与不足会影响网络银行的发展，削弱我
