3、onal，openAnglo—Americanremedysystemcoexist．Aftertheappearanceofacountry,privateremedieshavebeenintheshadowofthefactthatacountrymonopolizesremedies．However,themonopolyofremediesbyacountrymoredependsonthefreechoiceofrightssubjectsthanontheattitudesofacountry．Therearealotoffactorsaffectin

4、goptionsofsubjects，amongwhichsocialfactorsarecritical．Insociallife，thedirectfoundationonwhichprivateremediesexististhefactthatpeopleavoidlaw．Insocialcontrollingsystems，existenceofprivateremediesdependsonallkindsoffactors．Privateremediesarecloselyrelatedtohumannature，socialorder,country

5、andculture．Therefore，misunderstandingpeoplehaveaboutprivateremedieswillbemadeclearafteranalyzingtheconstituentfactorsofprivateremedies．Inaremedysystem，privateremediesandpublicremedieshavedifferentadvantagesanddisadvantagesrespectivelywhichdependoneachotherandcompensateforeachother．InCh
