2、nesspersonofforeigntradeshouldusethesetradepractice,conventionsandrulesandregulationsoflawaswellastradepolicywithflexibilitytotheadvantageofourcountry. Inaccordancewiththeabove-mentionedrequirements,thetextbooklaysstressonthespecificclauseofacontractforthein
3、ternationalsaleofgoods,boththesigningandfulfilmentofacontractanditsusualpractice.1.2WhatisinternationalTrade?Traditionally,theimportandexportpracticeortheinternationaltradebusinessconfinestotheimportandexportofgoods.However,intheUruguayRoundoftheGeneralAgree
4、mentonTariffsandTradestartingfrom1986,thetraditionaldefinitionofinternationaltradeisforthefirsttimeextendedtotheimportandexportoftechnologiesandservicesonaccountofthedevelopmentoftheinternationaleconomicexchange.Uptonow,manycountrieshaveacceptedthenewdefinit
5、ion.Inourcountry,thenewdefinitionhasbeenadoptedintolaw.ForeignTradeLawofthePeople’sRepublicofChinaadoptedattheSeventhSessionoftheStandingCommitteeoftheEighthNationalPeople’sCongressonMay12,1994definesintheArticle2that“ForthepurposesofthisLaw,foreigntraderefe
6、rstoimportandexportofgoodsandtechnologiesandtheinternationaltradeinservices.”1.3WhatAreCharacteristicofInternationalTradeinGoods?Theinternationaltradeismoreorlessthesamewiththedomestictradeinthatarebothessentiallycommercialactivitieswiththesamepurposeofsalea
7、ndpurchaseofgoodswhicharerestrictedbytherulesofeconomics.Buttheydifferfromeachotherinthefollowingaspects:First,sincetheinternationaltradeisdonebetweentwocountries,itislikelytobeaffectedbytheforeigntradepolicy,trademeasuresandforeignexchangecontrolofthecountr
