1、民诉时间点总结1.OneYearRule:Acasemaynotberemovedonthebasisofdiversityofcitizenshipjurisdictionmorethanoneyearafteritwascommencedinstatecourt.[28U.S.C.§1446(b)]Notealsothatacasemustberemovednolaterthan30daysafterthedefendantdiscovers,throughserviceofanamendedpleading,order,etc.,that
2、thecasehasbecomeremovable.2.Generally,adefendantmustfileanoticeofremovalwithin30days"afterreceiptbyorserviceonthatdefendantoftheinitialpleadingorsummons.Insomestates,thedefendantisservedwithsummonsandcopyofcomplaintnotatthesametime,sothe30daysstarttorunfromthemomentoftherece
3、iptofthecopyofcomplaint.Ifthedefendantsreceivesatdifferenttime,thenthelaterserveddefendantinitiatestimelyremoval,theearlierserveddefendantmayjoinintheremovaleventhoughhis30dayperiodforinitiatingremovalmayhaveexpired.3.Section1446(b)(3)alsoallowsadefendanttofileanoticeofremov
4、alwithin30daysofreceiptofanamendedpleading,motion,order,orothercourtpaper(suchasdiscoveryorotherstatecourtpleadings)thatshowsthatanonremovablecase(oranapparentlynonremovablecase)isinfactremovable.4.Aftertheremovalpetition,Ifthedefendanthasnotanswered,shemustanswerorpresentth
5、eotherdefensesorobjectionsavailabletoherundertheFederalRuleswithin21daysafterbeingserved,orwithinsevendaysafterfilingthepetitionforremoval,whicheverperiodislonger.Amendmentsmaybemadetopleadingsfiledbeforeremoval.5.DemandforJuryTrial:Therighttoajurytrialinacaseremovedtoafeder
6、alcourtmaybewaivedunlessatimelydemandforajurytrialisfiled.If,atthetimeofremoval,allnecessarypleadingshavebeenserved,atrialbyjurywillbegrantedtoapartysoentitled.Theremovingpartymustfileademandforjurytrialwithin14daysafterthenoticeofremovalisfiled.Thenonremovingpartymustfilefo
