2、ytheCommission){SEC(2007)1718}{SEC(2007)1720}ENENEXPLANATORYMEMORANDUM1)CONTEXTOFTHEPROPOSALGroundsforandobjectivesoftheproposalTheobjectiveoftheproposalistolaydownharmonisedrulesontheconstructionofmotorvehicleswithaviewtoensuringthefunctioningoftheinternalmarketwhileatthesametimeprovidingforahig

3、hlevelofenvironmentalprotectionregardingatmosphericemissions.TheproperfunctioningofthesinglemarketintheEuropeanUnionrequirescommonstandardslimitingtheemissionofatmosphericpollutantsfrommotorvehicles.ActionatCommunitylevelpreventsvaryingproductstandardsemergingacrossMemberStateswhichresultsinfragm

4、entationoftheinternalmarketandimpositionofunnecessarybarrierstointra-Communitytrade.MemberStatesandtheircitizensareconcernedabouttheriskstohumanhealthandtheenvironmentthatresultsfromairpollution.Althoughairqualityhasimprovedoverthepastdecade,therearestillsignificantairqualityproblemsthroughoutthe

5、EuropeanUnion,especiallyinurbanareasandindenselypopulatedregions.GeneralcontextEuroIVemissionlimitsfortrucksandbusesareapplicableasfrom9November2006and1EuroVemissionlimitswillapplyfrom1October2008fornewtype-approvalsinbothcases.Withnochangeinthepolicyofreducingemissionlevelsforheavydutymotorvehic

6、les,thereisahighriskthatthefunctioningoftheinternalmarketwouldbeimpairedwithMemberStatesseekingtotakeunilateralaction.PoorairqualitywillalsoremainanissueintheEuropeanUnionwithatmosphericpollutioncontinuingtohaveadetrimentalimpactonhumanhealth.ExistingprovisionsintheareaoftheproposalTherequirement

7、sforemissionsfromheavydutyvehiclesandenginesarepresentlygoverned12byDirective2005/55/ECasimplementedbyDirective2005/78/EC.ConsistencywiththeotherpoliciesandobjectivesoftheUnion1Directive2005/55/ECoftheEuropeanParliamen
