2、ieldandplayedamajorroleinstudieswhicharerelatedtothestudyoflanguagemeaning,suchascontextintranslation,contextinliteratureandcontextinlaw.Thisstudyaimstoexaminethedefinition,classificationandfunctionof“legalcontext”whichistheapplicationofcontextualtheoryintolegallanguageandtheinfluencesof“l

3、egalcontext”onlegaltranslationandlegalinterpretation.Throughthepresentstudy,itisfoundthat“legalcontext”hasitsownparticularcharacteristicscomparedwith“generalcontext”wherethoseparticularcharacteristicscandeviatelanguagemeaning.Thuslegalpractitionersshouldnevertakewordstooliterally,butrealiz

4、etheshiftoflanguagemeaningfromgeneralmeaningtoparticularmeaningintheprocessoflegalinterpretationandlegaltranslation.Thepresentstudychoosesthemethodofanalyzingfromgeneralityleveltoindividualitylevel.Generalitylevelreferstotheintroductionof“generalcontext”.Then,basedonthegeneralknowledgeofco

7、可替代的作用，离开了语境，意义的理解和表达就无从谈起。语境的这一功能促使对其研究从语用学中分离出来成为独立的跨学科研究领域。特别是在与研究语言意义密切相关的领域如：语境与翻译学，语境与文学，语境与法学中起着重要的作用。本文旨在研究法学中的语境观，即“法律语境”，其定义，分类和功能，以及该语境对法律意义的理解和法律翻译的影响。通过本文的研究，我们得出由于“法律语境”较于“一般语境”具有其特殊性，而特殊的语境必定会使语义产生偏离，那么法律工作者在从事法律意义阐释和法律翻译的过程中必须意识到此种语义转移，切忌望文生义。本
