1、“抢劫致人重伤、死亡”疑难问题研究摘要近几年来，随着经济的不断发展，抢劫案件也愈发频繁。然而，由于法律规定的不完善性，给司法部门的定罪问题带来了很多不便。但问题最终还是要解决，本文对抢劫罪的结果加重犯存在的众多观点进行梳理，从而提出自己的观点，希望对问题的解决有所帮助。本文共分三个部分。第一部分：本部分着重讨论了“抢劫致人重伤或死亡”主观方面的认定。笔者从三个方面来论证自己的观点：结果加重犯的概念，暴力的含义，及法律的具体规定。第二部分：着重讨论抢劫行为与加重结果之间的因果关系。要想让行为人对“抢劫致人重伤或死亡”的
2、重结果负责，必须找出抢劫行为与重结果之间有直接的、必然的因果关系。对那些偶然的事件，如被害人在被抢过程中因心脏病突发而死亡的，行为人不应当对此负责。另外，要认定因抢劫而致人重伤或死亡，我们还必须对人的范围进行限定，如“人”只能指被害人或第三人，而不能是行为人或其同伙。还有腹中婴儿是否应被包含在内，作者都进行了阐述。第三部分：本部分着重讨论了抢劫致人重伤或死亡在抢劫过程中的定罪问题。笔者认为，在抢劫前预谋杀人的，或在抢劫过程中，为了排除被害人的反抗而故意杀人的，故意杀人仍然是抢劫的手段之一，易定抢劫罪；在抢劫后故意杀人
