1、摘要我国现行《刑事诉讼法》中的不起诉制度，扩大了检察机关的起诉裁量权，体现了起诉便宜原则，有利于维护公众利益以及诉讼经济的实现。但是，由于我国在立法上缺乏一个系统完善的机制对不起诉权的运行进行制约，使得检察机关的不起诉权得不到有效监督，诉讼当事人的合法权益得不到很好的维护，导致司法实践中出现了许多困惑。因此，基于规范不起诉权的运行，以及维护诉讼当事人合法权益等目的，本文首先从理论层面对不起诉制约机制进行考量，探析不起诉制约机制的理论基础；然后通过审视我国不起诉制约机制的现状，从立法和司法角度对实践中出现的一系列问题进行了剖析，归纳出现行不起诉制约机制的几大弊端及成因。最后在考察、评析

2、具有代表意义的德、日等国的相关机制的基础上，提出对我国不起诉制约机制的重构设想。总体上来说，我国不起诉制约机制所存在问题的根源在于失衡，包括检察机关不起诉权和诉讼当事人合法权益之间的失衡，以及刑事诉讼被害人和被不起诉人之间诉讼权利的失衡，而失衡的关键在于缺少有效的权力制约机制。因此，不起诉制度中的监督和制约应围绕着规范不起诉权的行使来进行，使之既能遵循宽严相济的刑事政策，又符合以“起诉法定原则为主，起诉便宜原则为辅”的法理基础。关键词：不起诉；不起诉制约机制；平衡；权力制约IAbstractChinahasestablishedthecriminalnon-prosecutionsy
