2、序性。但笔者更倾向于将证明责任契约视为私法契约，而非诉讼契约。并通过“私法自治”论证了证明责任契约的合法性。目前我国《合同法》中既有一般的证明责任规范，也有法定的证明责任规范，但遗憾的是《合同法》中的证明责任规范尚且存在一定的问题，通过证明责任契约可以很好的弥补这一缺陷。针对不同的证明责任规范，证明责任契约具有不同的存在空间和条件。本文结合法条与案例，对证明责任契约进行具体分析，并进一步构建证明责任契约的具体制度，便于证明责任契约在市场经济生活中充分发挥其作用。关键词：证明责任证明责任规范证明责任契约作者：毛金玲指导老师：周永坤IAbs
