4、NPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle95thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),Actinginaccordancewiththepr

5、ocedurelaiddowninArticle251oftheTreaty(2),Whereas:(1)Theinternalmarketcomprisesanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalmustbeensured.TothatendacomprehensiveCommunitytypeapprovalsystemformotorvehicles,establishedbyCouncilDi

6、rective70/156/EECof6February1970ontheapproximationofthelawsoftheMemberStatesrelatingtothetypeapprovalofmotorvehiclesandtheirtrailers(3),isinplace.Thetechnicalrequirementsforthetypeapprovalofmotorvehicleswithregardtoemissionsshouldthereforebeharmonisedtoavoidrequiremen

7、tsthatdifferfromoneMemberStatetoanother,andtoensureahighlevelofenvironmentalprotection.(2)ThisRegulationisoneofanumberofseparateregulatoryactsinthecontextoftheCommunitytypeapprovalprocedureunderDirective70/156/EEC.Therefore,thatDirectiveshouldbeamendedaccordingly.(3)A
