3、es,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,HASADOPTEDTHISREGULATION:HavingregardtoRegulation(EC)No661/2009oftheEuropeanParliamentandoftheCouncilof13July2009concerningtype-Article1approvalrequirementsforthegeneralsafetyofmotorvehicles,theirtrailersandsyst
4、ems,componentsandseparatetechnicalScopeunitsintendedtherefor(1),andinparticularArticle14(1)(a)thereof,ThisRegulationappliestomotorvehiclesofcategoryM1,asdefinedinAnnexIItoDirective2007/46/EC.Whereas:Article2Definitions(1)Regulation(EC)No661/2009isaseparateRegulationforthe
5、purposesofthetype-approvalprocedureprovidedForthepurposesofthisRegulation,thefollowingdefinitionsforbyDirective2007/46/ECoftheEuropeanParliamentshallapply:andoftheCouncilof5September2007establishingaframeworkfortheapprovalofmotorvehiclesandtheirtrailers,andofsystems,compo
6、nentsandseparatetechnicalunitsintendedforsuchvehicles(Framework(1)‘vehicletypewithregardtowheelguards’meansvehiclesDirective)(2).whichdonotdifferinsuchessentialrespectsasthecharacteristicsofthewheelguardsortheminimumandmaximumtyreandwheelsizessuitableforfitment,takinginto
7、accounttheapplicabletyreenvelopes,rimsizesand(2)Regulation(EC)No661/2009repealsCouncilDirectivewheeloff-sets;78/549/EECof12June1978ontheapproximationofthelawsoftheMemberStatesrelatingtothewheelguardsofmotorvehicles(3).TherequirementssetoutinthatDirectiveshouldbecarriedove
