3、tion,butisequallysignificant.Allofthemostimportanthumanrightsareembodiedindomesticlaw,andstatesbearprimaryresponsibilityfortheirprotec-tionandtheirenforcement.Indeed,accordingtomany,itispreciselythetaskofpro-tectingandenforcinghumanrightsthatultimatelyjustifieswhate

4、verauthoritystateshave.1Anotionthatplayssuchapervasiverolebothatthedomesticandattheinternationallevelisinneedofjustification,andtothistaskphilosophershaveturnedinrecentyears.Initially,theobviousmoveinexplainingwhathumanrightsareandwhatjustifiestheirexistencehasbeent

5、olookatthenaturallawtradition,andinparticularatthenotionofnaturalrights: rightsthatallhumanbeingspossesssimplyinvirtueoftheirhumannature.2Thecrucialelementofthis“naturalistic”approach,whoserootcanbefoundinthethoughtofGrotius,Pufendorf,andLocke,istheclaimthathumanrig
